Terms and Conditions for Tickets and Hospitality

Part A – General Provisions

§ 1 Scope

(1) These Terms apply to all contracts for admission to events organised by Madison Sports GmbH, Mühlenstr. 8a, 14167 Berlin, Germany (“MSG”, “we”, “us”) under the SIXDAYS Cycling brand (“Event”). This includes standard tickets and VIP Hospitality packages (together “Tickets”). Part B applies to VIP Hospitality in addition to Part A. Where Part A and Part B conflict, Part B prevails.

(2) These Terms apply regardless of how the Ticket was purchased. Where we use a ticketing platform to sell Tickets, the platform acts solely as our technical service provider, and the contract is concluded with us. Terms of the platform operator apply only to the use of the platform itself, for example a customer account.

(3) Tickets are also sold through authorised sales partners (such as ticket agencies) and at the box office at the venue during the Event. In all these cases the contract for admission to the Event is concluded with us under these Terms. The sales partner’s own terms govern its intermediary services and any fees it charges in its own name.

(4) Where vouchers for our Events are sold by third parties, the purchase of the voucher is governed by that third party’s terms. When the voucher is exchanged for a Ticket, these Terms apply.

(5) These Terms apply to events for which we are named as organiser in the offer or on the Ticket. If an event under the SIXDAYS Cycling brand is organised by another organiser, the contract is concluded with that organiser and its terms apply. The organiser is named in the offer for the respective event.

(6) Conflicting or supplementary terms of business customers apply only if we have expressly agreed to them in text form.

(7) “Consumer” means any natural person who concludes a contract for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). “Business customer” means any natural or legal person, or partnership with legal capacity, acting in the exercise of its trade, business or profession (§ 14 BGB).

§ 2 Conclusion of Contract

(1) The presentation of Tickets on our website, in our ticket shop or elsewhere does not constitute a binding offer.

(2) Online ticket shop: By clicking the order button at the end of the ordering process, you submit a binding offer to purchase the selected Tickets. The contract is concluded when your payment has been successfully completed. You then receive an order confirmation by email.

(3) Box office: At the box office, the contract is concluded when payment is made and the Ticket is handed over.

(4) If, despite our availability controls, a technical error results in more Tickets being sold than are available, we may withdraw from the affected contracts. We will inform you without delay and refund any payment immediately.

(5) Orders for VIP Hospitality are additionally governed by Part B.

(6) Before submitting an online order, you can check and correct your entries as shown in the ordering process. Information on the technical steps to conclusion of the contract, on storage of the contract text and on the available contract languages is provided in the respective ordering process. These Terms can be retrieved and saved in the ordering process. The contract languages are those offered there, in particular German.

(7) Tickets may only be purchased by persons aged 18 or over.

§ 3 Prices and Payment

(1) The prices stated in the offer at the time of the order apply. Any additional fees are shown before the order is submitted.

(2) Children: Children under 6 are admitted free of charge but have no seat of their own. They nevertheless require a free children’s ticket, available at the box office. Children aged 6 to 15 (up to the day before their 16th birthday) pay the reduced children’s price shown for the respective category, including VIP Hospitality. Proof of age must be provided on request either during the purchase or at the entrance.

(3) The available payment methods are shown during the ordering process. Payments may be processed by payment service providers.

(4) We may limit the number of Tickets per order or per customer.

§ 4 Ticket Delivery

(1) Tickets purchased online are delivered electronically, as print@home or mobile tickets, to the email address you provide. You are responsible for providing a correct email address. Tickets purchased at the box office are handed over there.

(2) Please check your Tickets for correctness (date, category, number) immediately after receipt, and notify us without delay of any errors.

(3) Each Ticket carries a unique code, which grants admission once. Copies of a Ticket are invalid once the code has been used. We are not obliged to verify who is the rightful holder of a Ticket whose code is presented.

§ 5 No Right of Withdrawal

Under § 312g Abs. 2 Satz 1 Nr. 9 BGB, there is no statutory right of withdrawal for contracts concerning leisure services that are to be provided on a specific date. Every Ticket order is therefore binding once the contract has been concluded under § 2.

§ 6 Transfer and Resale

(1) Tickets are not personalised. You may pass Tickets on to third parties for private purposes, provided that the price does not exceed the amount you paid, including any fees we charged.

(2) The following are prohibited without our prior consent in text form:

(a) commercial resale of Tickets;

(b) resale at a price above the amount you paid;

(c) offering Tickets on auction sites or secondary ticketing platforms, unless we have expressly authorised the platform as an official resale channel;

(d) using Tickets as prizes in competitions, raffles or sweepstakes, for advertising purposes, or as part of travel, accommodation or other commercial packages.

Companies that pass Tickets free of charge to their own employees, customers or business partners are not affected by this paragraph (2).

(3) If you pass a Ticket on, you must inform the recipient that these Terms and the house rules apply.

(4) If Tickets are passed on or offered in breach of paragraph (2), we may block the affected Tickets and refuse admission. In that case, the purchase price will not be refunded.

§ 7 Admission, House Rules and Conduct at the Event

(1) Admission is granted only on presentation of a valid Ticket. Every person requires their own Ticket, including children under 6 (free children’s ticket, see § 3 (2)).

(2) The house rules of the venue operator Velomax Berlin Hallenbetriebs GmbH apply in their current version, available at https://www.velodrom.de/en/house-rules. They form part of these Terms. The instructions of security and event staff must be followed.

(3) In addition to the house rules, the following are not permitted without our prior consent:

(a) making photo, video or audio recordings of the Event for commercial purposes, and streaming or broadcasting the Event. Photos and short videos taken with smartphones for private purposes, including sharing them on personal social media accounts, are permitted unless explicitly prohibited by the organiser or the venue;

(b) advertising, promotional or marketing activities of any kind, including distributing flyers, samples or promotional items, and displaying commercial logos or messages with the intention of associating a brand with the Event;

(c) selling goods or services;

(d) entering the track area, or otherwise interfering with the race.

(4) Children and young persons: Children and young persons under 16 must be accompanied by a person with parental responsibility, or by an adult authorised by them, who supervises them throughout the Event. The Event involves high noise levels, light effects, music and large crowds. The accompanying adult is responsible for deciding whether attendance is suitable for the child and for providing appropriate hearing protection. The German Youth Protection Act (Jugendschutzgesetz) applies. In addition, no alcohol is served to persons under 16. Proof of age must be provided on request.

(5) Persons who seriously or repeatedly breach these Terms or the house rules may be refused admission or removed from the venue. In that case, the Ticket price will not be refunded.

(6) Tickets for seated areas entitle you to the seat stated on the Ticket. For organisational or safety reasons, we may assign you an equivalent or better seat. Tickets for standing areas do not entitle you to a specific position. For safety reasons, we may temporarily restrict access to standing areas once their capacity has been reached.

§ 8 Programme Changes, Postponement and Cancellation

(1) The content of the Event, such as the participating riders, the race programme and the schedule, may change. Such changes do not entitle you to a refund, provided the overall character of the Event is maintained and the change is reasonable. We do not guarantee the participation of individual riders.

(2) Cancellation: If we cancel an Event without a replacement, we will refund the ticket price you paid, including any fees we charged, without undue delay. Refunds are made through the channel through which the Ticket was purchased where possible. Fees charged by sales partners in their own name are refunded according to their terms.

(3) Postponement: If an Event is postponed to a new date, your Ticket remains valid for the new date. If you cannot attend on the new date, you may request a refund under paragraph (2) within 8 weeks of our announcement of the new date. The same applies if an Event is moved to another venue.

(4) Abandonment: If an Event day is abandoned after it has started, there is no entitlement to a refund of the Ticket price, unless we are responsible for the abandonment. If we are responsible for the abandonment, your statutory rights remain unaffected.

(5) Refunds are made only to the original purchaser, using the original payment method where possible. Refunded Tickets become invalid.

(6) We will publish information about changes on our website and, where possible, notify purchasers by email.

§ 9 Photo and Video Recordings

We, and third parties we have commissioned, make photo, video and audio recordings at the Event, including live streams. These are used for reporting on and promoting the Event. Visitors may appear in these recordings, particularly as part of the audience. The legal basis is our legitimate interest in documenting and promoting the Event (Art. 6 (1)(f) GDPR, in conjunction with § 23 KUG where applicable). Details, including your right to object, are set out in our privacy policy: https://sixdayweekend.com/en/privacy-policy/

§ 10 Liability

(1) We are liable without limitation:

  • for intent and gross negligence,
  • for injury to life, body or health,
  • for fraudulent concealment of a defect,
  • under the mandatory statutory product liability rules (in particular the Product Liability Act),
  • within the scope of any guarantee we have given.

(2) For slight negligence, we are liable only for breaches of material contractual obligations. These are obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment you regularly rely. In such cases, our liability is limited to the foreseeable damage typical for this type of contract.

(3) Any further liability is excluded. The limitations of liability in this section also apply in favour of our employees, representatives and vicarious agents, to the extent claims are asserted directly against them. The cases listed in paragraph (1) remain unaffected.

(4) Travel and accommodation costs are not reimbursed in the event of a cancellation or postponement, unless we are liable for them under paragraph (1) or (2).

§ 11 Data Protection

We process personal data in accordance with our privacy policy: https://sixdayweekend.com/en/privacy-policy/

§ 12 Final Provisions

(1) The laws of the Federal Republic of Germany apply. If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection of the mandatory consumer protection provisions of that country.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, or if you have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from the contract is Berlin. The statutory rules on jurisdiction apply to consumers.

(3) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(4) These Terms are available in German and English. In the event of any discrepancy, the German version prevails.

Part B – VIP Hospitality

§ 13 Scope of VIP Hospitality

(1) The services included in each VIP Hospitality package are those described in the offer valid at the time of booking. This typically includes access to a VIP area, beverages and catering – depending on the specific package. A VIP Ticket is valid only for the event day stated on it.

(2) Whether a VIP Ticket includes a specific seat, table or position follows from the offer valid at the time of booking. Unless the offer states otherwise, there is no entitlement to a specific seat or position.

(3) We may make changes to the menu, beverage selection, entertainment programme and VIP area layout, provided the overall value and character of the package are maintained.

§ 14 Booking and Conclusion of Contract

(1) Buy Online: VIP Hospitality can be booked online via the payment process linked on our website. By clicking the payment button at the end of the process, you submit a binding offer. The contract is concluded when your payment has been successfully completed. You then receive a confirmation by email. § 2 (4) applies.

(2) Request an Invoice: Where we offer booking on invoice (for example via a booking form or by email), the booking is a binding offer by the customer. The contract is concluded when we confirm the booking in text form, by order confirmation or by invoice. Who may book on invoice follows from the offer or the booking form.

(3) Sales agents: VIP Hospitality is also offered through independent sales agents. Contracts are always concluded with us under these Terms. Sales agents are not authorised to accept bookings on our behalf, or to make commitments that differ from these Terms or from our offer, unless we confirm them in text form.

§ 15 Prices and Payment

(1) The prices stated in the offer apply, see § 3 (1).

(2) Online bookings are payable immediately through the payment methods offered during the booking process.

(3) Bookings on invoice are payable by the due date stated in the offer, order confirmation or invoice; if none is stated, within 10 days of the invoice date. In any case, payment must be received before the start of the event day unless agreed otherwise in text form. Invoices are issued in the form required by law.

(4) We deliver VIP Tickets after receipt of payment in full, as soon as practicable and no later than 7 days before the event day, unless agreed otherwise in text form. For bookings made later, we deliver without undue delay after receipt of payment.

(5) If a customer does not pay by the due date, we may, after setting a reasonable grace period without success, withdraw from the contract and claim damages. The statutory provisions on default interest also apply.

§ 16 No Withdrawal Right; Binding Booking; Non-Use

(1) Consumers have no statutory right of withdrawal for contracts for VIP Hospitality. These are services connected with leisure activities for which the contract provides a specific date or period (§ 312g Abs. 2 Satz 1 Nr. 9 BGB; see also § 5).

(2) A VIP Hospitality booking concluded under § 14 is binding. The buyer is not granted any contractual right to withdraw from, cancel, rebook or return the booking, or to reduce the number of VIP Tickets booked. Statutory rights, in particular in the event of non-performance or for termination for good cause, and the buyer’s rights under § 8 remain unaffected.

(3) VIP Tickets are not personalised. The buyer may pass on VIP Tickets to third parties at any time and without notifying us, within the limits of § 6. Passing them on is the intended route if the buyer or the buyer’s guests are unable to attend.

(4) If the buyer does not use the VIP Tickets or wishes to cancel them, the price remains payable; no refund is made unless otherwise provided by law.

§ 17 Guests

(1) VIP Tickets are not personalised. The buyer does not have to provide guest names at the time of booking, and may decide freely which guests use the VIP Tickets.

(2) The buyer must inform its guests that these Terms and the house rules apply, and must ensure that the guests comply with them. Business customers are liable for damage culpably caused by their guests as if it were their own conduct.

(3) Catering and beverages are served in accordance with the statutory provisions. Service staff may refuse to serve visibly intoxicated persons.

§ 18 Children in the VIP Area

(1) The VIP hospitality areas include alcohol service, high noise levels, light effects and dense crowds. These are designed for adults and are not suitable for young children. We recommend that young children do not attend as VIP guests.

(2) Children aged 6 to 15 can attend at the reduced children’s price (§ 3 (2)). The children’s price includes the catering of the package, but no alcoholic beverages.

(3) Children under 6 are admitted free of charge with a free children’s ticket. They have no entitlement to a seat, a table or catering.

(4) The rules on accompaniment and supervision of minors in § 7 (4) apply.
